The Musician's
Business and Legal Guide: A Presentation of The

As I approach the second decade
of my career as an entertainment lawyer, there is one thing that
I have found to be true: the clients who are often best
poised to succeed are those who have prepared themselves for
the business and legal side of the industry. |
|
|
Clients, especially those just
starting out, are accustomed to wearing several hats out of necessity.
They write, play and record their own music. They get it pressed
into CDs, promote it and sell it at their shows or on their websites
(which they have probably designed themselves). They are
their own producer, manager, roadie, etc. |
|
|
But... it's never a good idea
to be your own lawyer! And that's true even if you are
a lawyer. Remember the old saw: "a lawyer who represent
him or herself has a fool for a client." But it is
a good idea to at least have some basic background on the business
and legal aspects of the industry. Why? Because when
the time comes to sit down with an entertainment attorney, you
will have an easier time communicating with the person who is
going to be your representative. And good communication
is one of the keys to making sure that your best interests are
properly maintained, protected and advocated. |

A good starting point for acquiring
some of this background knowledge is "The Musician's Business
& Legal Guide." The book concisely covers a wealth
of topics in a little over 400 pages in a very nonlawyer-friendly
format. Lots of headings, an aesthetic use of white space
and sidebars, and its "plain English" writing style,
make it easy on the eyes and the mind -- a handy reference indeed. |

So what does it cover? You
name it and it's pretty much there! Group breakups, copyrights,
trademarks, and publishing are covered as it is in most books.
But "The Musician's Business & Legal Guide"
also covers business plan development, sampling, new media, club
contracts, showcasing, publicity, how to read and evaluate royalty
statements and a host of other practical topics. Although
written by lawyers, this Guide covers the business side
of the industry and not just the legal. |
